concerning (rades and professions in the Danish W estindia Possessions.

C h a p . I I I .

§ 9.

For tbe exercise of a trade a tax of $18 shall be paid to the Land Trea^ury, ip St.Thomas with tbe addition of odo third thereof. ]f any perron desires to exercise more than one trade, the provisions contained in § 3 of tbis ordinance shall be acted upoD, with the exception t-pecified below.

A burgherbrief entitles the holder to exercise bis trade to any ex- tent and to employ assistants as well as to engage apprentices; tbe lat­

ter, bowever, only on condition, that he has a fixed residence in the Island and keeps a work shop, if the nature of the trade generally re- quires sucb.

A

shall

entitle the concerncd to perform all kinds of work, which belong to any of those trades; and a burgherbrief ns smitb, goldsmiib, coppersmith or tinsmith shall entitle to execute all kinds of work in metals. The same rule shall be applicable to other trades nearly connected with one anolber.

A burgherbrief as saddler ond painter may be taken out under one without any additional payment, if tbe concerned previously bas proved his skili or qualification by the performance of a piece of work in eaeb, and either of these trades shall be ccnsidered as iocluding that of up- holsterer.

I t shall not be considered as an infraction of the above rules, when

Wboever has taken out a burgherbrief as mechanio and bassettled in any of the Islands, sball be eDtitled to exercise his trade in the other Islands, without taking out a burgherbrief there, as long as he does not

«stablish a fixed residence there.

T h e widow of a burgher, who, pursuant to the provision contained in

§3 of tbis ordinance, will continue his trade,shall employ tbereat a person, who has proved his skiil in the respective trade by the

performance

of a Piece of work, as stated in the following $.

Any one, who w ill exercise any trade for bis owd account, shall, after previously having reported this to the policemaster of the place, be bound to perform or execute a piece of Work, belonging to such tråde and suitable to prove his proficiency in the sam e; otherwise the choice of the work shall be left to kimsclf. Persons, who prove to have quali- fied duly for such trade in the mother country, shall be dispensed from this rule.

Such pjece of work shall be executed under proper control, and shall when finished be referred to a committee, consisting of {.he police- master and two burgliers or expert persons. I f that committee finds the work properly executed. it shall give a certificate to this effeet, but if the committee declares, that the work executed does not prove, that the concerned is so proficient ns a master mechanic ought to be, he can not be admitted to new proof of his skili before the expiration of half a year.

A ny mechanic shall be permitted to make such proof of his proficiency in different trades. Ihacb ot the men shall receive for bis trouble S i, and in case it sbould be requisite to inspect the work in any piaee out of the towns moreover travelling charges ; those amounts shall be paid in ad- vance to the policemaster by the person, who reports his intention to qualify as aforesaid.

Whoover has obtained a certificate of having proved his compe- tency shall be entitled to exercise his trade for his own account and to avail himself of the assistance of his wife and children ; and the provi­

sions of the preoeding § regarding the works, that may be executed by the master mechanics mentioned thorein shall also be applicable to any one, who has obtained his certificate, but he shall not be permitted to cmploy other assistants or to engage apprentiees, without bavimr previ­

ously taken out a burgherbrief. ” r

§ 10.

No apprentiee shall be eDgaged otherwise, than by contract in writ- mg, entered into by the master mechanic and the parent or guardian of the apprentiee ; such contract shall specify besides the names of the concerned, the residence of the master and the age of the apprentiee : J ) Tbe trade and abilities the apprentiee shall he t a u g h t ;

~) l he time of apprcnticeship, which in ordinary cases shall not be shorter than 3 years, and in no case determine before the a p p r e u - tice has completed his 18th y e a r ;

3) Agreement with regard lo the maintenance and abode of the ap- prentice, or what else may be stipulated for hitn ;

4) T h e remuneration to be paid to the master for training the appren- tioe, if uny such he agreed upoo, as also, on the other baud, the componsation to be made by the master in case of non-perform- anee of the contract on his part.

T h e contracls, which may be written on unstamped paper, shall bc acknowledged before the policemaster, who shall attend to tbat they be made in conformity with the above, anu tbereafter note them in a proto- col kept for tilis purpose. I f the parties desire it, 6ucb contracts may

also be made before tbe policemaster and entered in the police journal, in wliich case the parties shall receive each a transcript without payment of any separate fee. A contract of apprenticesbip can not be altered or annulled by mutual agreernent of tbe parties, unless it be done before tbe policemaster and entered in the police journal.

Either party may demand tbe contract of apprenticesbip to be an­

nalled, on account of non-performance in essential points on the part of the other party, or on account of sucb circuinstances as render its cou- tinuation impossible or inespedient. For breach of contract or other im- proper conduct toward tbe apprentice the master shall ordinarily be ii- able to a fine, and it shall in this respect make no difference, wbether bis conduct is of such a nature as ougbt to cause tbe contract to be an­

nulled, or not.

Apprentices are subject to corrcction by the master, and are, more­

over, liable to proper punishment according to law, on oomplaint of tbe master to the policemaster for misconduct. F or noting a contract of apprenticeship a fee of $2 shall be paid to tbo police.

§ 12.

Sncli mechanics, as before the first of October 1852 have exercised a trade for their orøn account and kept assistant,journeymen and appren­

tices, shall, notwithstanding tbe provisions contained in tbe ordinance con- cerning proof of competency and taking out of burgherbrief, be permitted to coutinue their trade as bitberto, but tbey shall not, without previous- ly baving taken out a burgherbrief—for wliich purpose, however, no proof of skili shall be required of tbem,— be allowed to engage new ap- prentices. Persons, who eau produce evidence of liaving before tbe same period gained a livelihood by exercising a trade for their own ac­

count, but without keeping assistant journeymen or apprentices, shall likewise be permitted to continue such trade in the same manner, with the assistance of their wives and children and røithout proving their com- peteney by the performance of a piece of work.

The policemasters shall cause lists to be made out and laid out for public iDSpection, of all persons, coming under above provisions, in the same manner as prescribed by tbe 5th § of tbis ordinance with regard to tbe persons mentioned there; thereafter tbe names of tbe coucerned with the necessary explanations with regard to the trade, apprentices,

&c., shall be entered in a protoeol, kept for tbat purpose.

Oontracts of apprenticesbip which may exist before tbis ordinance comes into operation, but are not made in writing aud noted in the po­

lice oflice, shall within three months after the promulgation of this ordi­

nance of the preceding §, but without the payment of any fee, and otherwise be nuil and void.

§ 13.

Mechanics in the country, who are engaged on estates, shall not be bouud to prOvo their skili or to take out burgherbriefs as long as they are only working for Estates. If they will engage apprentices, to which lbey must have the consent of the owner of tbe E state, the provisions of

§ U aud the conclusion of § 12 shall be applicable, and in the oontract

of npprenticesliip there shall be entered tbe needful respecting the rela­

tion of ibe apprentico to the Estate, particularly wliat kind of work he is to do for the estate and what remunerution he or the inecbanic is to re- ceive for tho same.

§ 14.

Baking of bread and of cakes shall untill further continue as hither- to open to all, unless carried on at such a rate that the Goverumeut alter having obtained tbe Burgher-Couucil’s opinion on thesubject, may tbink it proper to enjoin on the concerned to take out a burgherbrief; but no proof of skiil shall be required in such cases.

The same rule shall until further be applicable to butchers of the smaller animals, but for butehering horned cattle and calves a burgher- brief shall be required agreeable to § 4 of tbis ordinance.

C h ap . I V .

§ 15.

Ownersbip of vessels is considered as beiog includ d in the burgberbricf for carrying on trade by Wholesale ; but it is besides the object of a spe- ial burgherbrief, for which a payrnent of $30 shall be made to the Land Treasury, in St. Thomas with the addition of one third of the same. I f there are several owuors of one veasel or a vessel is owned by share- holders, only one of the owners or shareholders shall be bound to take out a burgherbrief. W a n t of personal qualification for becoming a bur- gher, as for instaDce not being of age, 6ball however not be any impedi- ment to own vessels.

For a burgherbrief as arohitcct or as civil-engineer there shall be paid to tbe Land Treasury $3J, nnd for a burgherbrief as master of a vessol or as printer $24, in St. Thomas with the addition of one third of that arnount.

C hap . V.

§ 16.

For a burgherbrief as owner or administrator of a sugar estate with Works belonging thoreto, there shall be paid to the Land Treasury in St.

Croix $60, but in the two other Islands $40. I f several persons own an ostate betweou them, only odcof them shall be bound to take out a bur- ghorbrief.

For a burgherbrief as manager of an estate there shall be paid $30 to the Land Treasury in St. Croix, and in the two other Islands $24.

17-Persons, transgressmg this ordinance or committing acts, tending to elude lts directions, shall be liable to a fine of from $1 to 8100, wbicb iu cases of repetition shall be doubled; unless the provisions of the ordi­

nance dated 18th August 1S53 for prevention of vagraney be applicable to tbe case. Goods, illieitly carried about for sale, shall moreover be seized and confisoated for tbe benefit of the Land Treasury.

I be police shall officially atteud to, tbat no illicit traffic, trade or

profession is carried o n ; and moreover every person, exercising any trade or profession shall be at liberty to inform against any person, guil- ty of illicit exercise of bis trade. The police court shall have cogniz- ance of all cases concerning the right of exercising a trade, or the rela­

tions between master inechanics and tbeir assistants or apprentiees. The same rule shall apply to cases, in which defects in the execution or deli- very of some work are complained of, nnless the parties by contract in writiDg have agreed to have differences settled by the usual course of law.

§ 18.

T h e prohibitions and restrictions, imposed by the general laws or by local regulations with regard to the different kinds of trade (therein iu- clttded theexisting prohibition of the retail of rum and other spirituous li- quors, in the towns as well as the country, excopt by special liceDse), re-:

main in force, as far as they do not conflict with the provisions of this ordinanoe.

I n case any other trade or profession, than those mentioned in the l s t § of this ordinance, should in process of time become of sueh impprt- tance in the Islands, that it ougbt to be put under th e same eonditions, the Government shall be anthorized to docide to wbat class of trade or profession such business shall be reterred with regard to the payment for a buraherbrief &c.

§ 19.

The Governor of Our Westindia Possessions is authorised to fix the day from which this ordinance shall come into operation.

To which all concerned have to conform.
