08.12.2015 Kriegers Flak - final tender documents

As announced previously we are now publishing the last documents of the total tender package.

This includes:

- The licence for construction (appendix 6), including several sub-appendixes.

- A memorandum on the market framework for Kriegers Flak by Energinet.dk (as referenced in the initial tender conditions already published)

We are publishing these remaining documents – in both Danish and English – as part of one single tender document where we have collected all the documents (excluding only some of the sub-appendixes and other secondary material which have been enclosed as single documents; some of these documents are only in an English version).

In preparing the single tender document we have allowed ourselves to do some housekeeping, that is we have adjusted the language and updated certain dates.

For your benefit we are publishing two versions of the same material: One with track-changes and one clean version.

With this message all documents in the preliminary tender conditions for Kriegers Flak are now available.

02.11.2015 Tender Material for Kriegers Flak Delayed

The preliminary tender specifications for Kriegers Flak offshore wind farm are delayed. The tender material was scheduled to be published in October 2015. The DEA expects to publish the tender material in mid-November 2015.

29.10.2015 Great competition for the tender of the offshore wind farm Kriegers Flak

The DEA has prequalified a total of seven companies and consortia to participate in the tender of Denmark's largest offshore wind farm Kriegers Flak, totaling 600 MW.

There will be great competition to build the largest wind farm in Denmark, which will be located at Kriegers Flak in the Baltic Sea (600 MW). Of the eight applications, the DEA received before the deadline October 1, the Agency has prequalified seven companies and consortia to bid on the project. One candidate has been rejected, as it did not meet the criteria set out in the contract notice.

“We have the highest number of prequalified tenderers ever in Danish wind history. I both hope and believe that the great competition for winning the Kriegers Flak tender will lead to the best possible price for the benefit of Danish electricity consumers”, says the Danish Minister for Energy, Utilities and Climate, Lars Christian Lilleholt.

The prequalified tenderers for Kriegers Flak are as follows:

1. Kriegers Flak ApS (owned by Energie Baden Württemberg AG (EnBW AG)).

2. Wpd HOFOR Stadtwerke München, Kriegers Flak SPV.

3. European Energy Offshore Consortium (owned by European Energy A/S and Boralex Europe S.A.).

4. A not yet established company by Vattenfall Vindkraft A/S.

5. Kriegers Flak Offshore Wind I/S (a not yet established company by Statoil ASA and E.ON Wind Denmark AB).

6. ScottishPower Renewable Energy Limited 7. DONG Energy Wind Power A/S

”I am pleased that the DEA alongside with the decision today is opening the Danish market for several new players, who choose to invest in Denmark for the first time. This confirms that Denmark remains an attractive investment destination, when it comes to green investments”, concludes Lars Christian Lilleholt.

The DEA will implement the tender over the next year. The decision of the winner of the tender is expected to be published in December 2016.

Facts:

 Kriegers Flak offshore wind farm will have a capacity of 600 MW and will supply approximately 600,000 households with electricity.

 The wind farm is expected to be in operation before the end of 2021.

 When the wind farm is fully operational, it will increase the share of electricity production based on wind power with seven percentage points, according to the DEA's baseline projections from 2014.

09.10.2015 EIA for Kriegers Flak published for public consultation

The Nature Agency and the Danish Energy Agency have published the assessment of the environmental impact (EIA) for the establishment of the wind farm Kriegers Flak with associated land facilities for public consultation. The period of consultation is eight weeks. Within this period the two agencies together with Energinet.dk will conduct several public meetings where local citizens will have the opportunity to ask questions about the environmental aspects of the project.

You may find the published EIA documents (Danish only) under published material. Later this month the DEA will publish a non-technical resume in English. Several of the most important offshore-related background reports are already available in English under published material at the DEAs tender web page.

The draft EIA concludes that the construction and presence of the offshore wind farm, the transformer platforms, the cables routing onshore and the associated onshore installations will have impacts on the environment. In by far the majority of cases, however, the environmental impacts will be temporary and are linked to the actual construction work.

In addition to improving security of supply in East Denmark, the benefit of completing the project will be that in the long term there will be reductions in CO2 emissions in Denmark.

The results of the EIA and the public consultations will be reflected in the terms of the model licences, including the licence for pre-investigations and construction, which are being elaborated by the Danish Energy Agency as part of the tender material.

The Danish Nature Agency and the Danish Energy Agency are jointly the EIA authority for the project; the Danish Nature Agency is the authority for onshore installations, while Danish Energy Agency is the authority of offshore installations (turbines and routing onshore etc.). Energinet.dk is responsible for the construction of grid connection onshore and offshore and is also responsible for preparing preliminary investigations and EIA for the whole project.

A draft EIA has already been through a consultation with the Danish public authorities.

05.10.2015 The “Kriegers Flak – Combined Grid Solution” is now approved by the European Commission

The European Commission has now granted the revised technical layout for the world’s first offshore interconnection that is using the national grid connections to offshore wind farms. The new interconnection “Kriegers Flak – Combined Grid Solution” is planned between the Danish region of Zealand and German Mecklenburg-Western Pomerania and will make use of two existing German wind farms (Baltic I and II) and the coming Danish Kriegers Flak wind farm. It will have a capacity of 400 megawatts (MW). Operation is planned to start by the end of 2018. The project will receive funding up to 150 million Euros from the European Energy Programme for Recovery (EEPR). Read more on Energinet.dk webpage.

01.10.2015 Great interest in participating in the bidding of Kriegers Flak offshore wind farm

The DEA has today received 8 number of applications for prequalification to participate in the tender for Kriegers Flak.

The DEA will now examine whether the applications meet the economic, financial and technical minimum criteria in the contract notice from May 6 2015. Pending the outcome, the DEA will inform applicants and subsequently publish the names of the candidates who are pre-qualified to participate.

30.09.2015 In case you cannot submit an original hard copy of a declaration of support before deadline

In case you cannot submit the original hard copy version of the signed declaration of support before the deadline (this is of course preferable), we recommend that you make sure that the electronic version of the signed support declaration is forwarded as quickly as possible and that you use a partner/ lawyer or the like in Denmark to print a version and make sure that this hard copy version is delivered to the DEA before the expiration of the deadline for pre-qualification.

Afterwards we will of course require you to submit the original hard copy.

For the sake of good order please note that the DEA is of the opinion that this procedure is permissible pursuant to the applicable public procurement rules and principles, subject to the assessment of the Complaint Board for Public Procurement should a complaint on this matter be filed.

16.09.2015 Prolongation of the deadline for questions relating to prequalification to Monday the 21st of September 2015, 09:00 hrs.

After consultation with our legal advisor, the DEA has decided to prolong the deadline for questions relating to

prequalification to Monday the 21st of September 2015, 09:00 hrs. The DEA wants to ensure that all potential candidates have the opportunity to ask questions relating to the draft on the review clause which sets out more detailed rules on permitted changes to the concessionaire after signing the contract. Furthermore, the DEA wants to achieve as much transparency as possible. The DEA has received many questions and it is of the DEA’s impression that there might be a need for asking further questions after the DEA’s has revealed the answers to the questions already received.

14.09.2015 Draft on a review clause setting out the more detailed rules on permitted changes to the concessionaire after signing the concession agreement

As stated in the executive presentation on “Subsequent changes of a tenderer – New offshore wind tenders in Denmark – a general, non-exhaustive overview”, the DEA can inform all potential candidates that the DEA intends to include a review clause in the concession agreement. The review clause will set out the more detailed rules on permitted changes to the concessionaire and it will be included in the preliminary tender conditions that will be published soon.

The DEA put forward a draft on this review clause in order for candidates to get an idea of the content of this review clause before prequalification. It is important to underline that it is only a draft and that the DEA might change the wording and content of the review clause in the final tender conditions.

13.07.2015 The DEA offers to hold meetings with economic operators interested in the prequalification for the tender of Krigers Flak

The DEA offers all economic operators, who are interested in submitting a request to be prequalified for the tender of Krigers Flak, the opportunity to participate in a meeting with the DEA to discuss questions related to the prequalification.

Questions have to be sent to the DEA in advance of the meeting. Contact information on the secretariat is listed in the top right corner.

The questions and answers to the questions will be made public under “question and answers” shortly after the meeting.

The questions have to be written in an anonymous form, so that they can be made public without the DEA having to rephrase them.

The DEA will not reveal any information about other economic operators in these meetings.

18.06.2015 New executive presentation on the possibility of changing the tenderer

The executive presentation on the possibility of changing the tenderer highlights the current limitations that follow from Danish jurisprudence with regard to the possibility of making any subsequent changes in the tenderer after pre- qualification and throughout the duration of the contract.

The presentation, however also informs that the DEA is going to introduce more flexibility after the award of the concessions through the insertion of a clear, precise and unequivocal review clause in the concession contract which among other things will allow the concessionaire to add a new financial member as well as replace a joint-venture member under certain circumstances.

18.06.2015 New information on the web page and summer holidays in the secretariat

The secretariat is looking forward to helping you with any questions or contributions you may have.

Answers to specific questions regarding both the contract notice and the project itself are continuously being published on the tender web page in respect of the principles of equal treatment and transparency.

Please beware, that the secretariat is not fully manned in July because of the traditional summer holidays in Denmark.

The response time may therefore be longer than usual. Furthermore, the secretariat will be closed in week 30.

The deadline for applying for pre-qualification is no later than 1 October 2015 at 13:00 hrs. (Danish time).

21.05.2015 Concession agreement, licences for preliminary studies and construction of HR3 now available

12.05.2015 Supplementary geotechnical investigations at planned KFA and KFB platform sites

Supplementary geotechnical investigations were conducted at the planned KFA and KFB platform sites in June-August 2014. The purpose of the ground investigation was to provide supplementary geotechnical data for the design of proposed offshore platforms.

The geotechnical data and results from the investigations are now available to download at Energinet.dk’s website under

06.05.2015 Contract notice for Kriegers Flak now published

Today the contract notice for Kriegers Flak was notified to the European Commissions on Tenders Electronic Daily (TED - The internal reference number is 161094-2015-EN).

This marks the formal start of the tender procedure.

The notice has been published on TED - http://ted.europa.eu - with the title: DK-Copenhagen K: Wind farm.

Please note that work on the pre-qualification questionnaire (PQQ) is in progress and will be published shortly together with a special presentation on the rules regarding joint and several liability.

At the same time the DEA is publishing an updated timeline for the tender procedure, see right section of the web page.

The timeline is the outcome of the recent dialogue with the market which informed the DEA during the work on the contract notice.

Today the DEA is also publishing its response to the dialogue in a new paper.

23.04.2015 Technical information on the position of the cable routes from the substations for Kriegers Flak

Energinet.dk has made a chart available which illustrates the preliminary cable routes and connections to Sweden and Germany, and the planned platform positions. To view the chart, please click here.

13.03.2015 News on EWEA and updates on KF and HR3

The EWEA Offshore 2015 conference successfully completed. On Wednesday the 11th the DEA held a presentation on the Danish tenders at the seminar ‘Experience and Explore Denmark’. The slide show from the presentation is now available here.

NEWS on Kriegers Flak:

 The contract notice and the results from the last round of dialogue on Kriegers Flak, including an up-dated timeline, are expected to be published in April 2015. The small delay of one month compared to the existing timeline is due to the need for a proper and thorough evaluation of the many replies received during the market dialogue.

 The DEA has decided that the grid voltage for Kriegers Flak will be at the level of 33 kV. The early decision has been made following the DEA’s dialogue with the market. The general conclusion is that it would be too risky to go for a 66 kv grid connection at a time where the technology is not sufficiently rolled out in the market.

NEWS on Horns Rev 3:

The DEA has received a positive decision from the European Commission on the notified state aid in regard to the the Horns Rev 3 tender. The decision is clear and does not require any amendments to the tender. Following normal state aid procedure the decision will be made public by the European Commission at a later stage.

However the question of the long term financing of the Danish PSO is not covered by the decision. Therefore, The Concession Agreement remains conditional upon that an agreement is been reached by a majority of the Danish

Parliament on the new terms of financing the price supplement for the Horns Rev 3 offshore wind farm in compliance with the Treaty.

27.02.2015 Vattenfall Vindkraft AS wins Horns Rev 3 tender

The winning tender for the wind farm Horns Rev 3 came from Vattenfall Vindkraft A/S who have agreed a price of 10.31 Eurocent per. kWh. In comparison with previous price assumptions, this means that Danish consumers will experience a saving of approximately 295 million Euros. over the next 11-12 years, which is the period during which the offshore wind farm will be in receipt of subsidies. Thereafter, the Horns Rev 3 facility will produce electricity at the market price and will no longer receive any form of subsidy.

The winning bid is well below the 14.07 Eurocent (15.15 Eurocent in fixed 2015-prices) which is the price being charged by Anholt Offshore Wind Farm. Horns Rev 3 is thus 32 percent cheaper than the last time Denmark built an offshore wind farm. This makes it the cheapest offshore wind park in Europe at the moment.

The DEA is looking forward to continuing the tenders for the Kriegers Flak project and the near shore project.

06.02.2015 Final tender material for Horns Rev 3 with few minor changes

A new version of the final tender material for Horns Rev 3 with few minor changes is now published before the best and final offer must be handed to the Danish Energy Agency no later than 16 February 2015 at 14.00 H.

In the final tender material for Horns Rev 3, published 5. December 2014, the Danish Energy agency reserved the right to carry out changes to the final tender material.

The changes made to the final tender material for Horns Rev 3 are deemed to be either of minor importance or to be improvements to the benefit of the bidders and regard mainly the following elements:

 Time extension may apply in the event that 2 UXOs are found (the change was previously announced on 2 February 2015 )

 Wording stating that a new special procedure for blasting of UXOs will be issued after final bid. The new wording is a consequence of an extended dialogue with the military regarding UXOs.

 Updated information on costs regarding pre-investigations and switchgear.

 Adjustments to the co-ordinates for pre-investigation areas.

 Adjustments to appendix 4.

A version with track-changes compared to the final tender conditions from 5. December 2014 is enclosed in both English and Danish.

30.01.2015 Marine IEA background reports for Kriegers Flak now available

The Danish Energy Agency (DEA) invites potential tenderers to submit written replies and other comments before 19 January, 2015.

The DEA is also available for bilateral meetings in the period from January 21 – 27, 2015.

05.12.2014 Final tender material for Horns Rev 3 is now published

Following the final approval from the parties behind the Energy Agreement from 2012 the DEA can now make the final tender material for the concession to construct and operate the 400 MW Horns Rev 3 offshore wind farm available in both English and Danish. A version with track-changes compared to the preliminary tender conditions is available as well.

All the essential amendments made to the tender material after the conclusion of negotiations with pre-qualified bidders are listed in point 10 “Negotiations and other changes to the tender material”.

A reservation for approval by the European Commission has been included in the tender material for Horns Rev 3 as well as a reservation for funding of the Horns Rev 3 project.

In the DEA’s dialogue with the European Commission regarding the state aid cases on renewable energy the

Commission has presented the view that the tendering model for Horns Rev 3 also could constitute state aid and for this reason needs to be notified to the European Commission.

DEA is therefore engaged in an intensive dialogue with the Commission with the shared aim of processing the case on a fast track. The European Commission has already received information on the tendering model for Horns Rev 3 including the preliminary tender material for Horns Rev 3. Next step is a formal notification of the tendering model for Horns Rev 3 including the final tender material. From the dialogue with the Commission it is in the DEA’s hope that the Commission may be able to present a state aid decision before the deadline for the final offer. If the decision from the Commission is received before the signing of the contract the reservation will be removed from the contract.

The reservation on funding is a result of the dialogue this autumn with the European Commission. The dialogue has highlighted problems with discrimination in the way the Public Service Obligation (PSO) is currently designed. The PSO is the major source of funding of all subsidies provided to renewable energy projects in Denmark, including offshore wind power.

The Danish government and the political parties behind the Energy Agreement 2012 are fully committed to finding a solution to the problems in the beginning of next year. For that purpose an inter- ministerial task force has been created with the aim of presenting a solution in March 2015.

02.12.2014 Dialogue paper on Kriegers Flak delayed

The dialogue paper on Kriegers Flak is somewhat delayed.

02.12.2014 The topside of the transformer platform at Horns Rev 3 will be made in the Netherlands.

Energinet.dk has signed contract with the Dutch company HSM Offshore B.V. for the construction of the topside of the transformer platform at Horns Rev 3.

HSM Offshore B.V. was the same company that delivered the topsides for the other two transformer platforms at the two other Horns Rev offshore wind farms (Horns Rev 1 and 2), hence their long experience building offshore platforms.

The new topside is expected to arrive in Esbjerg in the beginning of April 2016 to be installed in the weeks that follow.

Energinet.dk will continue contracting with other companies regarding the delivery of the foundations as well as supporting structure for the transformer platform.

28.10.2014 New round of dialogue on the Kriegers Flak project

In order to ensure that potential tenderers can offer their views on these framework conditions and contribute to making the contents of these conditions attractive and flexible for the market, the Danish Energy Agency decided to conduct a technical dialogue in May 2013 covering the two projects Horns Rev 3 and Kriegers Flak.

While the tender for Horns Rev 3 has proceeded as planned, there have been important changes to the Kriegers Flak project following the first and successful market dialogue.

The changes have led to important amendments of the original timetable of the tender procedure as well as pushed back the time delay for commissioning the whole farm with two years from 2020 to 2022 (the changes were published on September 6).

Considering the magnitude of the changes the Danish Energy Agency has decided to renew the call for a technical dialogue concerning Kriegers Flak. The aim is still to make the tendering procedure and conditions as attractive and flexible as possible.

The form of the dialogue will be through the Danish Energy Agency asking the market specific questions on the basis of selected themes in this dialogue paper. Potential tenderers will be able to detail their written replies and views in bilateral meetings with the Danish Energy Agency. The replies will help drafting of the preliminary tender conditions.

02.09.2014 New certainty for the Danish offshore tenders - revised timeline for Kriegers Flak

Following political negotiations between the Danish government and the opposition in the Parliament several

amendments that concern the Danish offshore tenders have been made to the cross-party political energy agreement from 2012.

The amendments to the offshore initiatives in the agreement are the following

- The deadline for the commissioning of the whole of the Kriegers Flak offshore wind farm has been forwarded with two years until the end of 2021. This means developers will have two more years to construct the farm.

- The nearshore tender is reduced from 450 MW to 350 MW (The 50 MW earmarked for demonstration projects remain intact).

- Offshore wind projects closer to the shore are expected to be less expensive to build than larger projects further offshore. Therefore, the near shore tender is now subject to a cap for the acceptable offers of an average maximum price of 0,70 DKK per kWh for 50.000 full load hours for the 350 MW. Offers above the average of 0,70 DKK will - if relevant - be subject to political acceptance.

“With the new agreement a new political certainty has been created for the tenders of the Danish offshore projects. The road is now cleared for the tender procedures to continue in a safe investment climate. For Kriegers Flak the amendment is a clear improvement as it provides the developer with more time to construct the farm. For the near shore tenders the amendment means a reduced capacity and price cap. I am certain though that developers will still consider 350 MW to be quite a sizable project compared to the farms being built today and that bidders will be able to capitalize on the fact that they are allowed to build near shore“ says Katrine Nissen, Head of department , from the DEA

The aim of the political negotiations has been to cut costs and increase productivity and competitiveness of the country’s businesses while still maintaining the original target of the energy agreement from 2012 of achieving 50 percent of wind energy in the electricity production by 2020.

At the same time the DEA announces amendments to the timeline for the Kriegers Flak bidding procedure. The reason is the delay of the EIA caused by changes to the design of the grid connection by the Danish TSO, Energinet.dk. For the same reason the date of guaranteed grid connection is changed from July 1 2018 to January 1 2019.

“The amendment of the timeline for Kriegers Flak has become unavoidable following the changes to the grid connection concept from Energinet.dk which had to abandon their original plans for a combined grid solution connecting Kriegers Flak to both Germany and Denmark due to unexpected price hikes with respect to the main HVDC components on the platforms. The new grid concept is based on proven AC-technology used already for the grid connection of the Anholt Offshore Wind Farm. This concept necessitates however new pre-investigations on land in the context of the ongoing EIA which also means that we have been forced to adopt a new timeline as the bidding procedure hinges on the completion of the full EIA.”, says Katrine Nissen from the DEA.

14.06.2014 Revised MetOcean study for Horns Rev 3

The MetOcean study for Horns Rev 3 (carried out by DMI) has since January 2014 been in the process of being examined by Germanischer Lloyd Services GmbH for the purpose of certification.

Germanischer Lloyd Services GmbH accepts the study as providing information on general MetOcean conditions (wind, waves, currents etc.) at a level of detail making potential concessionaries able to make a qualified economical bid towards construction of the planned offshore wind farm.

Further validation of the study, however, is required if the study is to be certified for detailed design of the foundation support structure or the wind turbine. Therefore DMI has been asked by the DEA to prepare a response to the comments which have not been closed by Germanischer Lloyd Services GmbH. On this basis and in dialogue with the pre-qualified parties the DEA will decide whether to close the certification process or proceed.

During the certification process new information has been added to the MetOcean study, errors corrected and misunderstandings clarified in the text. The cover note summarizes this.

03.06.2014 The noise modelling report for Horns Rev 3 has been extended with more impact assessments

The underwater noise impact assessment undertaken for Horns Rev 3 was considering a worst case of the installation of large 10 MW turbines with 10 meter foundations being installed with the largest hydraulic hammers available.

For comparable reasons 6 MW and 8 MW turbines now also have been included in the assessment. The enclosed report has consequently been extended to account for this.

As previously announced in the published tender material, the DEA expect to publish specific requirements regarding noise mitigation in September 2014.

24.06.2014 Horns Rev 2 Metocean data released to pre-qualified bidders

The DEA/Energinet.dk as part of the pre-investigations will provide access to all of DONG Energy’s measurements of wind (LIDAR and met mast data) and waves from the Horns Rev 2 offshore wind farm located close to the offshore site designated for the construction of the coming Horns Rev 3 wind farm.

Access to the raw data is granted to all pre-qualified bidders on the basis on the completion of a non-disclosure agreement. The data is provided as supplement to the Metocean study report also available and may allow even more thoroughly site assessments regarding Metocean conditions by bidders prior to their submission of their bid.

18.06.2014 Invitation to tender for Horns Rev 3 now available

Following the final approval of the government and the parties behind the Energy Agreement from 2012 the DEA is now in a position where it can make the preliminary tender material for the concession to construct and operate the 400 MW Horns Rev 3 offshore wind farm available to the four prequalified bidders: Vattenfal Wind Power A/S, Dong Energy Wind Power A/S, E.ON Wind Denmark AB og Statoil ASA.

In the comprehensive tender material the four bidders will find the tender conditions as well as a draft concession agreement together with all the model licences and authorisations needed for the immediate construction and operation of the farm after the award of the concession to the winning bidder.

The language of the preliminary tender material is Danish, but an English version will be published in a short time.

For the purpose of providing the bidders with more time to prepare their bids the deadline for the submission of the first indicative offer has been postponed with two weeks (from September 2 to September 16, 2014). A revised timeline of the tender process is included in the tender conditions. The tender is a negotiated procedure.

06.06.14 Offshore wind turbines at Kriegers Flak to be connected to the grid with AC-cables

Energinet.dk 's board of directors has approved a new business case for the grid connection of the 600 MW offshore wind farm to be built at Kriegers Flak.

Energinet.dk is preparing the construction of a ‘traditional’ AC grid connection facility for the offshore wind farm at Krieger's Flak. This means that the grid connection will be based on alternating current, in the same way as the existing Danish offshore wind farms are connected to the grid.

Originally it was planned to base the grid connection on DC–cables combined with an electrical interconnection to Germany via the Danish and German wind farms in the Baltic Sea. However, this so called Combined Grid Solution has now been abandoned as the converter station at sea proved far more expensive than budgeted.

- In order to finish the grid connected in mid-2018 as we are committed to, we have to start put the major components in the system up for tender now. At the same time we are working together with our German partner 50 Hertz Transmission on developing a new technical solution to the planned interconnection between Denmark and Germany, which can be connected to the AC-based grid, says Dorthe Vinther, Vice President for system development at Energinet.dk.

In 2012, Energinet.dk received an order from the Danish Ministry of Climate, Energy and Building which stated that Energinet.dk should deliver the grid connection for 600 MW offshore wind farm at Kriegers Flak no later than 1 of July 2018.

Next Energinet.dk will submit an application for the AC-grid connection to the Minister of Climate, Energy and Building.

The application must be approved by the minister, before Energinet.dk can start investing in the AC grid connection.

Furthermore Energinet.dk will request the Danish Nature Agency to include the planned new onshore facilities in the on- going environmental impact assessment. The budget for the AC grid connection is approximately 3.5 billion DKK.

At sea, the grid connection will consists of two 220 kV offshore transformer platforms that collect power from the app.

600 MW offshore wind turbines. The two platforms are interconnected by a submarine cable. Each platform will be connected to shore south of Rødvig on Sealand by one approx. 45 km long 220 kV submarine cable.

20.05.14 Public hearing on the EIA for Horns Rev 3

The public hearing on the EIA and its background reports for Horns Rev 3 have begun. The hearing will last up to and including 29 July 2014. The data can be found on the danish version of the DEAs webpage. The EIA is only avalalible in Danish. Some of the background reports are however in English.

09.05.14 Four major international energy companies prequalified to bid for Horns Rev 3

Today the DEA announced the decision to prequalify Statoil ASA , E.ON Wind Denmark AB, Vattenfall Wind Power A / S and DONG Energy Wind Power A/S for the tender of the Horns Rev 3 offshore wind farm.

This means that all four applicants for prequalification have been selected to submit a first indicative offer for the concession contract where price is the only criteria.

Morten Bæk, the CEO of the Danish Energy Agency, says:

“The Danish Energy Agency today is prequalifying a range of both known and new players in the Danish wind power market. The outcome is highly satisfactory considering both the number and profile of the prequalified applicants. It is difficult to imagine a more competitive field in today’s market. Strong competition is the key to lowering the costs for offshore wind energy.”

Horns Rev 3 is the first concession to be tendered for on the basis of the Energy Agreement from 2012. In comparison, the last Danish tender for the Anholt offshore wind farm in 2010 only attracted one bidder.

With the aim of securing the highest level of competition, the Danish Energy Agency for more than one year has been involved in a technical dialogue with potential bidders. This dialogue has helped raise attention for the Danish projects in the international market place.

04.04.2014 Correction to the Tender Notice regarding Horns Rev 3

The correction concerns (I) section II.1.2, lit. G (II) and section VI.2, no. 10 of the Contract Notice as further explained in the following:

1. DEA will remove the requirement that the required financial information shall be in accordance with IFRS. The reason is that DEA has examined the possibility, of an applicant that does not submit annual reports in

accordance with IFRS, to get a statement regarding the required financial information in accordance with IFRS. It is the view of DEA that while this is possible, it will entail quite substantial costs for the applicants that do not submit annual reports in accordance with IFRS. As a consequence, the "cash flow statement" is also removed from the list in the Pre-Qualification Questionnaire, question B.2, regarding financial information which the applicant must provide along with the full annual reports.

Thus, it is not a requirement that the required financial information shall be in accordance with IFRS.

2. Furthermore, the wording of section VI.2, no. 10 regarding guarantees etc. will be changed. The terminology

"compliance bond" will be changed to "penalty for defective performance". It will also be clarified that this penalty is applicable only until connection of the first wind turbine to the grid (and not for the entire construction period).

Finally, it will be added that in order to ensure the obligation to decommission the wind farm, the tender

documents will include a decommissioning guarantee. The terms – including the exact amount - will be stated in the tender documents along with other guarantees, if any.

27.03.2014 Results from diver examination of 5 potential UXO objects within OWF HR3

In the period 27th of February 2014 to March 1st 2014 diver examination of 5 magnetic anomalies, and hence 5 potential UXO objects, was carried out. The survey involved attempts of re-locating the targets by using a metal detector, and of free laying the potential objects using suction and jetting methods in buffer zones around the estimated depths and positions of the magnetic anomalies. At 2 locations no buried objects were found and/or detected by the metal detector, but at the other 3 locations buried metallic objects were found including a small anchor and metal debris. No unexploded ordnances or mines were located.

The survey report is now published at the HR3 website at Energinet.dk.

Offshore EIA technical background reports for Kriegers Flak will be published sequentially as they are finalized in draft version from now and until June 2014 tentatively. The first draft will be published in the beginning of April 2014.

The EIA technical background reports for both Horns Rev 3 and Kriegers Flak will now be made available as drafts. The reports cover all offshore aspects of the environmental pre-investigations. The final and approved reports will be published together with the EIA.

For Horns Rev 3 the EIA will be made public available in the beginning of May 2014. Unfortunately, the EIA for Kriegers Flak will be delayed due to the new requirement by the Agency for Nature in Denmark to include another alternative site for the construction of the onshore transmission facilities. This entails new surveys and analysis. We will publish a new date as soon as possible.

The decision to publish the technical background reports as drafts constitutes a new practice compared to previous tenders where the final reports were only released in conjunction with the approved EIA. The new approach reflects the general commitment to maximum openness in the Danish tenders. Bidders may benefit from the information even though the reports may still be amended following the scrutiny and approval by the authorities. In the case of Kriegers Flak the early release may bridge the information gap created by the delayed EIA.

12.02.2014 DEA evaluation of technical dialogue concerning design of AC-platforms and purchase of switchgear

The AC-platforms planned for Horns Rev 3 and Kriegers Flak will not provide space available for installation of extra power supplies or compensation equipment. Bidders are asked to consider other options.

This decision follows detailed analysis by ENDK and DEA following the technical dialogue meeting on September 10 2013.

Focus in the analysis has been on the possible implications for platform design, the risk assessment and time schedule.

The conclusion is that the concept design of the platform does not allow for extra space and any changes would lead to an unacceptable delay. In addition, the risk assessment points to an increased risk for critical damages to the platform.

Switchgear to be purchased by Energinet.dk

The DEA can now give final confirmation on the decision to make it possible for Energinet.dk to purchase and install the switchgear. This alternative solution was first raised by the DEA during the dialogue in May 2013 and further discussed at the following technical meeting on September 10 2013.

It has proven impossible to rearrange the time schedule in order to give time for a solution where the winner of the tender has enough time to purchase and engineer the switchgear onshore. The decision allows for an onshore installation which is deemed considerably cheaper compared to an offshore installation

Specifications will be published in the tender process. The contract will hereafter be transferred on commercial condition to the concession owner.

13.01.2014 New measures for the required air gap between sea level and turbine blade tip

The technical project descriptions for both projects stipulate that the air gap between Mean Sea Level (MSL) and blade tip will be determined based on the actual project, but also that a minimum of approximately 23m above MSL is expected.

Following new dialogue with the Danish Maritime Authority (DMA), the DMA has accepted to reduce the measure for the required air gap to a minimum of 20m between blade tip and HAT (Highest Astronomcal Tide)

The DMA is also announcing that it will apply Highest Astronomical Tide (HAT) and not Mean Sea Level (MSL) when determining the minimum air gap between the sea and the blade tip.

The technical project descriptions for both projects will be amendend accordingly and new versions will be uploaded shortly.

Because there is no tide in the Baltic Sea, there is no difference between HAT and MSL in the case of Kriegers Flak. For Horns Rev 3 there is a difference of app. 0,7m relative to MSL. The difference between HAT and MSL for Horns Rev 3 is depicted in the Metocean report, cp. Table 7.9 (see last column):

"The contract notice for Horns Rev 3 marks an important milestone in our efforts to create more competition to build Danish offshore wind farms and attract new capital for the green transition in Denmark. Today's announcement is the result of an intensive dialogue with the market to create the right framework conditions in Denmark. We have managed to find solutions that we believe will ensure serious bidders and more competition in the Danish market," says Climate, Energy and Building Minister Martin Lidegaard.

The contract notice sets out the main principles of bidding and outlines the requirements necessary to become

prequalified in order to participate in the tender, which will be conducted as a negotiated procedure. The prequalification ensures that only those who tender and are able to undertake the task, both financially and technically, can participate in the tendering procedure.

The requirements for prequalification are customised to create more competition and bring new players and financial institutions to the Danish market. Among other things, there are now more relaxed requirements for financial and economic capacity in comparison to the last bidding process undertaken for an offshore wind farm in Denmark at Anholt in 2010. There is also an assurance that those prequalified are fit to handle the task. The technical requirements ensure the necessary experience in the installation and operation of offshore wind farms.

"The prequalification is an important part of a new procurement model that involves both a considerable amount of technical dialogue and subsequent negotiations with the bidders. It is an important departure from the last bid for the Anholt offshore wind farm in 2010 where we ended up receiving only one offer. Instead of sitting behind closed doors this time, we have chosen to implement some of the most open and transparent procurement measures the industry has ever seen. It has secured a massive interest in the Danish projects," says Climate, Energy and Building Minister Martin Lidegaard.

The rest of the tender specifications will be published in early 2014 and will include among other things additional economic conditions for the establishment and operation of the park as well as a draft concession agreement.. The deadline for applying for prequalification is the 23rd April 2014.

05.12.2013 Proposal for the special market scheme for Kriegers Flak now public

The Kriegers Flak wind farm will be connected to a so called common grid solution (CGS) which will allow for cross- border trade in the European market coupling.

While the Danish TSO, Energinet.dk, is responsible for the Danish part of the CGS, 50Hertz Transmission is responsible for the German part.

Energinet.dk has developed a proposal for a special market scheme for the Kriegers Flak wind farm that takes into account the special features of the CGS.

The scheme stipulates the rules for selling power from the Kriegers Flak wind farm, including the use of the common grid solution.

The proposal has now been forwarded to the Danish Energy Regulatory Authority (DERA) for consent. DERA regulates the Danish markets for electricity, natural gas and district heating.

15.10.2013 Decision on grid voltage for both wind farms and other technical news

The DEA has decided that the grid voltages for both Horns Rev 3 and Kriegers Flak will be at the level of 33 kV. The decision follows the technical dialogue before summer with interested parties. The DEA believes that 33 kV will ensure the highest level of competition for both projects.

The technical project descriptions for both projects have been amended accordingly, see column to the right. Other minor amendments include clarification of issues relating to the marking of turbines following discussions with the Danish Maritime Authority and the Danish Transport Authority in September 2013. Further, DRAFT watermarks have been removed. This does not exclude future amendments, however, as the EIA-process evolves. Readers should therefore be aware of the dating of the text.

Following the invitation to dialogue before summer we received questions on the anticipated market regulation. Two questions remained unanswered. See the questions and answers here.

15.10.2013 Updated Technical Project Descriptions for Horns Rev 3 and Kriegers Flak

A draft of the prequalification criteria (for financial, economic and technical capacity) is now available and the DEA hereby give potential applicants the opportunity:

- To correct any misunderstandings or mistakes in the wording of the criteria in draft.

- To pinpoint any of the drafted criteria which do not reflect current market conditions.

- To submit any questions related to the actual comprehension of the criteria in draft

04.10.2013 Metocean studies - Horns Rev 3 and Krieger's Flak Offshore Wind Farms

On the basis of the notice from the Danish Energy Agency (DEA) to Energinet.dk dated 23 April 2013, Energinet.dk has provided information on waves, wind and current (metocean) for the areas for the future offshore wind farms at Horns Rev 3 and Kriegers Flak.

Furthermore, raw data used in the two studies has been compiled.

For Kriegers Flak the raw data is already available on the website.

The raw data is now available for Horns Rev 3. The raw data consists of time series of parameters used over 10 years for the four locations, which has been used in the metocean study for Horns Rev 3. The data can be found here.

In addition the metocean studies will be updated with relevant Hs / Tp diagrams by the end of October 2013.

Based on the completed market dialogue DEA has decided that the conducted metocean-studies for the two sites should undergo a certification. This work is initiated by Energinet.dk, and will end no later than 1 May 2014.

04.07.13 – Evaluation of dialogue, geophysical results available for Horns Rev 3 and other news.

Evaluation of dialogue

The second round of dialogue on key requirements in the coming tenders is now finalized. The DEA is thanking all participants for valuable input.

As a direct result of the dialogue the timetable is being adjusted in order to provide bidders with more flexibility. Further, geotechnical and Met-Ocean information will be published ahead of the previously announced schedule.

Read the note which summarizes the responses we received. The DEA offers its evaluation of the input received and where possible presents the thinking that will guide the DEA in formulating the requirements of the coming tenders in the near future.

Read also the Appendix which contains answers to the many detailed questions and comments received during the dialogue on many technical aspects of the tender, EIA, platform design etc.

Geophysical results

Geophysical results are now available for Horns Rev 3. The results for Kriegers Flak will be ready 15th of August 2013 at the latest.

Technical meeting on switchgears and platforms in September

At the request of participants in the dialogue Energinet.dk will organize a technical dialogue meeting where Energinet.dk will give detailed technical information about the medium voltage switchgear and other platform related issues.

29.05.2013 HR3 – MetOcean: Validation of DMI’s model suite for the Horns Rev 3 Area

The report on the validation of DMI’s model suite for the Horns Rev 3 Area is now available. The document is a validation of the results from the DMI model used in the Met-Ocean study for the Horns Rev 3 Offshore Wind Farm. The validation is an addition to the general model-data validations carried out at DMI. The addition covers a much larger area and includes more model parameters and observations.

Please note that the deadline for comments in regards to the results from the first round of dialogue concerning the pre- investigations, including the model suite for the Met-Ocean study, has been extended from May 31 to June 7 2013.

Contributions to the dialogue can be send to the DEA.

08.05.2013 Agenda and dialogue documents now available for kick-off conference on May 13 Dialogue documents as well as the agenda for the conference on May 13 2013 is available now.

The dialogue paper forms the basis for our dialogue with the market. As part of the dialogue we also publish the draft documents of the technical project description for Horns Rev 3 and the technical project description for Kriegers Flak that will determine the scope of the EIA of the two projects.

The conference in Copenhagen is hosted by the minister for Climate, Energy and Building, Mr. Martin Lidegaard, and

kicks off a new round of technical dialogue where potential bidders and other relevant parties are invited to comment on specific questions regarding the tendering process and some of the principal terms and requirements related to the tenders.

The Danish Energy Agency invites all interested parties to join the conference at the Danish Energy Agency, Amaliegade 44 in the center of Copenhagen (please contact reception desk at arrival).

The technical dialogue will be completed in connection with the Kick-off Conference on 13 May 2013 on the basis of the dialogue paper. Potential tenderers will be able to detail their replies and views in bilateral meetings with the DEA in the period from 27 May 2013 to 30 May 2013. You are invited to send your answers and comments to the DEA before 7th of June 2013. These replies will subsequently be published anonymously on the Danish Energy Agency’s website.

08.05.2013 Results from the first dialogue round on the pre-investigations

We are now able to publish the results from our recent round of technical dialogue meetings concerning the preliminary plans for pre-investigations (concerning both geological and metocean data). During the dialogue we have received valuable input and we wish to thank all contributors.
